Terms of Service
To be a participating organization, please carefully read this in its entirety. As part of the 2024 online registration form on BGgives.org, your organization will digitally submit your acceptance of the terms of this agreement. The term of this agreement is from execution until May 31, 2025.
Your organization is eligible to participate in the GoodGiving Challenge as defined by the terms listed below. As an organization participating in the GoodGiving Challenge, Blue Grass Community Foundation asks that you certify the following information:
The Incorporation Status of the Organization
- 501(c)(3) Public Charity in good standing with the Internal Revenue Service
- Operates under the fiscal sponsorship of a 501(c)(3) public charity in good standing with the Internal Revenue Service
Supporting Documentation:
Your organization must check all required fields and submit this online Terms and Agreement along with required supporting documents in the online registration form in order to participate.
- Proof of GuideStar.org Gold Seal of Transparency (or higher). Nonprofits must earn a Gold Seal of Transparency on GuideStar.org to register for the GoodGiving Challenge. Use the resources on Candid.org to assist your organization with this process. Your organization must upload proof of Gold or Platinum Seal (e.g. screenshot of listing on GuideStar.org, or screenshot of email confirmation) prior to the registration deadline of August 30, 2024.
- Proof of Kentucky Attorney General registration. Nonprofits must be registered to solicit funds as a charitable organization with the Kentucky Attorney General's office, as is required by Kentucky law. Your organization must upload proof of registration with KYOAG (e.g. screenshot of organization's name on this list) prior to the registration deadline of August 30, 2024.
To participate in the GoodGiving Challenge, all organizations must comply with the following:
- Agree that the registration fee is non-refundable and that organizations are responsible for registering for the GoodGiving Challenge during the designated registration period.
- Certify that all information provided on the registration form is accurate. Once registered, information cannot be changed by the organization or Blue Grass Community Foundation. Any organization that falsely reports its information will be determined ineligible to participate.
- Agree that Blue Grass Community Foundation will keep my organization’s information confidential and will use the information to determine eligibility for prizes, BGgives.org search and leaderboard categories, and post-giving day data analyses.
- Be physically located in one or more of the counties in Blue Grass Community Foundation’s service area: Anderson, Bath, Bourbon, Boyle, Clark, Fayette, Franklin, Harrison, Jessamine, Madison, Magoffin, Montgomery, Morgan, Rowan, Scott or Woodford.
- Agree that institutions of faith may only participate if fundraising for secular charitable programming, such as a food pantry that is operated from the organization. Educational programs operated within a religious institution, such as a parochial school, may participate so long as funding is for educational and/or secular purposes.
- Agree that organizations may not participate if they are in violation of Blue Grass Community Foundation values aligned philanthropy policy.
- Agree to notify Blue Grass Community Foundation within 30 days should the nonprofit organization cease, substantially reduce its operations, or should the Internal Revenue Service propose to revoke its Section 501(c)(3) status.
Gifts/Donors
- Agree that gifts must be made on BGgives.org between 9am on December 3 and 11:59pm on Friday, December 6 to be eligible for the GoodGiving Challenge.
- Agree that online donations can be made using credit/debit card, ACH transfer or Blue Grass Community Foundation donor advised fund grant. Gifts of cash, checks, stocks or IRA distributions will not be accepted.
- Agree that the minimum gift on BGgives.org is $10. There is no maximum gift amount.
- Acknowledge that the organization is solely responsible for cultivating each donor and that Blue Grass Community Foundation is only responsible for providing a tax receipt. An email tax receipt is sent immediately after a completed transaction.
- Agree that each gift processed through BGgives.org is 100% tax-deductible. No goods or services are exchanged for gifts or as payment for ‘quid pro quo’ items.
- Agree that all gifts must be made by a donor. BGgives.org is not intended as a vehicle to facilitate gifts that the organization has solicited through other means. (Example: payment of event sponsorships, pledge payments, checks collected over a period of time.)
- Agree that nonprofits may not use their own assets to make a gift to their organization through the Challenge (this includes depositing a cash, check or other gift from a donor and then making a gift to the Challenge).
- Agree that every gift made through BGgives.org is irrevocable and unrestricted. If a nonprofit organization encourages donations for particular purposes, including promoting project specific peer fundraising pages, it is up to the nonprofit organization to honor the donor intent for said purposes.
- Agree that donations to the Challenge are considered donations to Blue Grass Community Foundation and are granted in aggregate to the participating nonprofits at the conclusion of the Challenge, less fees and including any matching funds and prizes won. Please be aware that failed transactions do occur. Final checks to nonprofits will be reduced by the amount of any failed transactions, and the nonprofit’s donation report will be updated to reflect the new total.
- Understand that final checks will not be awarded in the same calendar year as the Challenge due to time needed to verify donations with donor’s financial institutions, create and review reporting, and allocate match and prize dollars.
- While nonprofits may choose to issue a thank you note to donors, they should not issue a charitable acknowledgement because the donor will receive an official charitable receipt via email immediately following his/her donation.
- All donations will be paid to the chosen nonprofit net of fees. Blue Grass Community Foundation supports this giving event as a community service and does not financially profit from any fees.
- Donors may elect to "OPT IN" to help cover fees during checkout.
- Agree that gifts will be donated to organizations in full, excluding any transaction fees not covered by the individual donor.
- Agree that organizations will use the BGgives.org giving platform to solicit donations for the giving day.
- Unless a Donor requests to remain anonymous, participating nonprofits will receive the following information about their donors: contact information, amount, date and time of gift and any special instructions. Special instructions may include if the gift is in memory or honor of someone, or if the gift is for a specific program of the nonprofit. For gifts from anonymous donors, nonprofits will receive only information about the amount, date and time of gift.
- Agree that the Leaderboard provides a snapshot summary of charitable activity during the Challenge. It is not used to determine the outcome of Challenge events and may not always reflect real-time reporting on donations made.
Matches + Prizes
- Agree that Donations are time stamped and processed when a Donor completes checkout on the BGgives.org website. The time stamp is based on the platform, not the Donor’s computer. The time stamp cannot be adjusted.
- Agree that prizes awarded during the Blue Grass Community Foundation Endowment Challenge will be contributed to a qualifying nonprofit’s Endowment Fund at Blue Grass Community Foundation. Nonprofit organizations will only be considered qualifying for endowment challenge prizes if the organization has an endowment fund at Blue Grass Community Foundation. Endowment funds must be opened prior to November 1 and meet Blue Grass Community Foundation’s endowment fund minimum of $10,000 to be eligible.
- Blue Grass Community Foundation reserves the right to review all charitable donations and determine their eligibility as qualifying gifts for all GoodGiving Challenge matches and prizes. Gifts found in violation of these rules may be disqualified from receiving matches and prizes. Violations may also result in nonprofit disqualification for future Challenge participation.
- Agree that prizes may be revoked or withheld if donations or matches can’t be validated or if donations do not qualify as “Unique Donations,” including falsifying donor email addresses or matches.
- Acknowledge that a “Unique Donation” is defined as one gift of $10 or more to one organization from one donor. Anyone who attempts to game the system runs the risk of being caught in our audit.
- Acknowledge that Blue Grass Community Foundation will not disclose if a particular donation receives matching funds or prizes.
- Acknowledge that Blue Grass Community Foundation will provide a break-down of matches and prizes received that includes aggregates for each match period.
- Agree that in the event of ties, prizes will be split evenly.
- Agree that only organizations who have indicated Clark County as their mailing address county on the registration form and can agree to use all Clark County Community Foundation matching funds in Clark County will be eligible for the Clark County Community Foundation match pool.
Peer-to-Peer & Matching Fundraising Campaigns
- Agree that individuals or groups raising funds for an organization through peer-to-peer fundraising cannot offer incentives (time, product, or consideration) in exchange for gifts made through BGgives.org.
- Nonprofit participants are encouraged to recruit their own match donors to further incentivize giving. These optional match donations may be made via BGgives.org, or directly to the nonprofit at the conclusion of the Challenge. Only match payments made on BGgives.org by credit card or eCheck/ACH will be eligible for prizes and other matching dollars. Match payments made by cash or by check made payable to the nonprofit and delivered directly to the nonprofit will not count toward their challenge totals. Blue Grass Community Foundation will not include any match prizes in the Challenge or leaderboard totals unless they are entered as donations through bggives.org.
Marketing/Media/PR
- Agree to publicize participation with the GoodGiving Challenge in all appropriate outlets, such as the organization’s website, newsletters and email communications, and to use the official and current 2024 versions of the GoodGiving Challenge logos and trademarks when doing so. Blue Grass Community Foundation grants you a revocable, royalty-free, and non-exclusive license to use the GoodGiving Challenge logos and trademarks solely for such purposes.
- Agree if the organization engages in social media (such as Facebook, Twitter, Instagram or LinkedIn), usage will be in a reasonable and appropriate way to support the GoodGiving Challenge using the hashtag #GoodGivingChallenge and BGgives.org.
- Agree that Blue Grass Community Foundation will be the primary contact for all major media outlets, including TV, radio, print, and online, and will coordinate all campaign coverage, promotion and interviews. In order to ensure equitable coverage for all participating organizations, if you are approached by a media outlet, you are required to notify Blue Grass Community Foundation prior to the interview. Participants are encouraged to attend GoodGiving Challenge events for which Blue Grass Community Foundation has coordinated media coverage.
- Acknowledge that Blue Grass Community Foundation has the right to use images uploaded to profiles and photos posted on social media with the hashtag #GoodGivingChallenge for GoodGiving Challenge marketing purposes. The organization will be credited.
Profiles
- Certify that, to the best of your knowledge, all information entered into your BGgives.org profile is accurate and correct.
- Agree to complete an annual profile update, participate in surveys and use BGgives.org in the spirit in which it was created.
- Agree that if an organization is ineligible to participate, Blue Grass Community Foundation may remove the organization’s profile from BGgives.org at its sole discretion.
Additional Requirements for the GoodGiving Challenge
- Participating organizations must complete their online profiles, complete all participation requirements, and be approved by Blue Grass Community Foundation to participate in the GoodGiving Challenge, by Friday, August 30, 2024.
- Organizations will be able to make edits to their profile at any time.
- Organizations are highly encouraged to utilize the training opportunities and materials provided by Blue Grass Community Foundation to increase their fundraising success during the GoodGiving Challenge. These support materials include toolkits, webinars and in-person or virtual training sessions. Blue Grass Community Foundation does not guarantee the success of any participating organization.
Blue Grass Community Foundation provides the following:
Visibility to Foundation Fundholders - Training Opportunities - Donation Platform - Donor Data – Branding Assets + Materials - Promotion + Media - Customer Service – Match Challenges – Prize Incentives.
- Blue Grass Community Foundation will not share or sell donor information to any other organization or entity but does reserve the right to communicate with donors for the purpose of user surveys, newsletters, and general education about philanthropy.
- While Blue Grass Community Foundation strives to provide its participants with the best possible experience, we rely on third parties to administer and facilitate the online giving platform and, therefore, disclaim any implied or expressed warranties related to the functionality of that platform.
- By entering into the Term Agreement, you understand and agree Blue Grass Community Foundation is in no way responsible for malfunctions in that platform, including, but not limited to, service interruptions, lost data, donation accounting errors, or software malfunctions, and, therefore, you agree to assume these risks and hold Blue Grass Community Foundation harmless for any such incident.
GoodGiving Challenge Fees
Registration:
- Registration fees cover your participation in the GoodGiving Challenge by giving access to all training and support materials, resources toolkit, access to additional funding from the matches and prizes pool, increased visibility through local media platforms, as well as exposure to Blue Grass Community Foundation fundholders.
- Registration is a flat fee of $500 for all organizations. This fee has been the same since 2011, and goes to support and promotion of the GoodGiving Challenge.
Platform:
- BGgives.org is a cost-effective and successful fundraising platform. GiveGab retains a 2.8% campaign management fee from all donations.
- Credit Card: Processing fees are an additional 2.2% + $0.30 for (MasterCard, Visa, Discover, and American Express).
- ACH Transfer: Users can also make a gift using their ACH checking account. These gifts will incur a $3 flat fee in addition to the 2.8% platform fee.
100% of all donations are tax-deductible for the donor.
Blue Grass Community Foundation is a 501(c)(3) charitable organization and prioritizes raising incentive funds to benefit all participating organizations.
Blue Grass Community Foundation reserves the right to amend, modify, or waive any of the previous terms and conditions without your consent and interpret and construe these terms and conditions at its sole discretion.
You certify that your organization is in good standing with the Commonwealth of Kentucky and the IRS and is not in violation of any applicable state or federal law, ordinance, or regulation. You understand and agree that participation in the GoodGiving Challenge does not constitute an endorsement by the Blue Grass Community Foundation or any Blue Grass Community Foundation partner of our organization or mission.
You further represent that all of the information supplied in the registration form is correct and that you understand and accept the terms and conditions of the Terms of Service and Agreement incorporated herein by reference. You represent that you have all of the requisite authority to bind your organization to the Term Agreement. You agree to notify Blue Grass Community Foundation immediately in writing of any change that would cause the representations in this form to become incorrect or incomplete.
You agree to attempt to resolve any claim relating to this Term Agreement, relating to any services provided by Blue Grass Community Foundation, or in any way arising from the relationship with Blue Grass Community Foundation, its officers, directors, employees, agents, or service providers through mediation before initiating any formal legal proceeding. This Term Agreement shall be construed under the laws of the state of Kentucky.
